These Terms of Service ("Terms") govern your access to and use of Housely's website, mobile apps, and services (the "Service"). By using the Service, you agree to these Terms.

1. About Housely

2. Definitions

In these Terms:

"you" or "user" means any person or entity using the Service
"Service" means the Housely website, apps, and related services
"Listing" means a property listing posted on the Service
"Content" means text, images, documents, or other material posted

3. Acceptance and updates

By using the Service, you accept these Terms. We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.

4. Eligibility

You must be at least 18 years old and have legal capacity to enter into binding contracts to use the Service. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

5. The Service

Housely provides a rental matching platform that enables landlords and renters to discover listings, connect, and communicate. Housely is not an estate agent, attorney, conveyancer, or financial advisor and has no authority to negotiate or conclude agreements on your behalf. You are responsible for your own decisions and contracts.

6. Accounts and security

When creating an account, you agree to:

Provide accurate and complete information
Keep your login credentials secure
Notify us promptly of unauthorized access

You are responsible for all activity on your account. We may suspend or terminate accounts that violate these Terms.

7. Listings and content

You are responsible for the content you post, including:

Listing accuracy (pricing, availability, property details)
Ownership or authorization to list the property
Compliance with applicable laws and regulations

You grant Housely a non-exclusive, royalty-free, worldwide license to display and distribute your content for the purpose of operating the Service. We may remove or restrict content that violates these Terms or applicable law.

We do not endorse listings or verify every piece of content. You are responsible for the material you submit and the consequences of posting it.

8. Acceptable use

You agree not to:

Use the Service for unlawful, fraudulent, or misleading activity
Post content that is defamatory, obscene, hateful, or harmful to minors
Infringe intellectual property or privacy rights of others
Use robots, spiders, scrapers, data mining, or other automated tools to access, monitor, extract, or copy the Service
Reverse engineer or attempt to discover source code
Interfere with or overload the Service or its infrastructure
Access areas you are not authorized to access

9. Security

You may not attempt to violate the security of the Service, including:

Probing or testing vulnerabilities without authorization
Submitting malware, spam, or disruptive traffic
Forging headers or impersonating other users
Deleting or altering content posted by others without permission

Security violations may result in suspension, termination, and legal action.

10. Payments

Payment transactions are processed by PayFast. Housely does not store full payment card data. Fees and payment terms will be displayed during the transaction or on applicable pricing pages.

11. Verification and screening

Housely may offer document verification and screening tools to support safer renting. These tools do not constitute a credit check and should not be treated as legal or financial advice.

12. Intellectual property

The Housely name, logos, and platform content are owned by Housely or its licensors. You may not use, copy, or modify our branding or content without written permission, except as required to use the Service.

13. Third-party content and links

The Service may display third-party content or links. We do not control or endorse third-party websites, and we are not responsible for their content, policies, or practices.

14. Disclaimer of warranties

The Service is provided "as is" and "as available." We do not guarantee that listings are accurate, that users will transact, or that the Service will be uninterrupted, secure, or error-free. We do not warrant that downloads or files are free from harmful components.

15. Limitation of liability

To the extent permitted by law, Housely is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Any liability is limited to the amount paid to Housely in the six months preceding the claim.

16. Indemnity

You agree to indemnify and hold Housely harmless from claims, damages, or expenses arising from your content, conduct, or misuse of the Service.

17. Privacy and cookies

Our Privacy Policy explains how we handle personal information and cookies. By using the Service, you agree to our Privacy Policy.

18. Suspension and termination

We may suspend or terminate access to the Service if you violate these Terms, misuse the platform, or pose a risk to other users. You may close your account at any time by contacting support.

19. Severability and entire agreement

If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. These Terms are the entire agreement between you and Housely regarding the Service.

20. Governing law and disputes

These Terms are governed by the laws of South Africa. Any dispute that cannot be resolved informally may be referred to arbitration in Cape Town under the rules of the Arbitration Foundation of Southern Africa, unless otherwise required by applicable law.

21. Changes to these terms

We may update these Terms from time to time. The latest version will be posted on this page with an updated date.
